Man claims his bankrupt brother did not take car loan

JOHOR BARU: A coffee shop assistant declared a bankrupt by the High Court here last year for failing to settle a car loan did not apply for it, claimed his brother.

Gan Kim Chai, 40, did not borrow the money to buy a second-hand car as the loan was issued to a stranger using his lost MyKad.

“My brother lost his MyKad in December 2003 and had lodged a police report. He also went to the National Registration Department to get a new card,” said Gan Ah Hook at a press conference organised by MCA Public Services and Complaints Bureau chief Jason Teoh yesterday.

Ah Hook said his brother Kim Chai was a slow learner and forgetful.

He said his brother lost his MyKad twice – in 2003 and last year.

“My brother received a letter from a bank last June asking him to settle the remaining RM60,000 loan which he did not borrow,” Ah Hook said.

He claimed the borrower had used his brother’s MyKad to get the car loan from the bank with the address at Taman Puteri Wangsa, while his brother’s address on his MyKad was Taman Bukit Indah.

He said the family members met the bank officers to settle the case as they claimed the bank failed to carry out due diligence before approving the loan.

But the bank insisted that Kim Chai had to settle the outstanding amount.

“My brother does not even drive and he earns about RM1,000 monthly. The bank should have done its homework before giving out the loan,” said Ah Hook.

Teoh said he would assist Kim Chai by giving free legal service to him and would meet with the bank and Bank Negara to settle the case.
